INVERSE CONDEMNATION

Sometimes the government will take an action or cause an event that results in a constitutional taking of property and the government does not file a formal condemnation action. This can give rise to an inverse condemnation claim against the government. There are different types of inverse condemnations, including regulatory takings arising out of the government’s application of zoning laws, blight or injury caused by governmental pre-condemnation activity, and even physical or other interference with a property owner’s enjoyment and use of property.

Determining whether the government’s conduct gives rise to an inverse condemnation claim is not an easy task. It takes a studied knowledge of inverse condemnation law and practical experience. The lawyers at Berry Reynolds & Rogowski PC offer that combination of knowledge and experience necessary to evaluate and pursue a successful inverse condemnation claim against the government.
